Please read these Terms and Conditions ("Terms", "Agreement") carefully before accessing or using any service offered through Kundali Shuddhi ("Platform", "we", "us", "our"), a brand owned and operated by Vitta Mantrana Pvt Ltd, a company incorporated under the Companies Act, 2013, having its registered office at Duplex House 243, Manorama Estate, Rasulgarh, Bhubaneswar, Odisha 751010, India.

By registering on our Platform, clicking "I Agree", purchasing any service, or otherwise accessing www.kundalishuddhi.com, you ("User", "Member", "you", "your") confirm that you have read, understood, and agree to be bound by these Terms along with our Privacy Policy.

These Terms are drafted in compliance with the Information Technology Act, 2000 ("IT Act"), the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Digital Personal Data Protection Act, 2023 ("DPDPA"), the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020, and other applicable Indian laws and regulations.

If you do not agree to these Terms in their entirety, you must immediately discontinue use of the Platform and its Services.

1. DEFINITIONS

• "Company" means Vitta Mantrana Pvt Ltd, registered at Duplex House 243, Manorama Estate, Rasulgarh, Bhubaneswar, Odisha 751010, India.
• "Brand / Platform" means Kundali Shuddhi, the consumer-facing brand operated by the Company, accessible at www.kundalishuddhi.com and any associated mobile applications.
• "Services" means all offerings on the Platform, including AI-generated Kundali readings, astrological reports, AI-suggested remedies, online puja facilitation, digital subscriptions, and the sale of Physical Products.
• "AI Services" means features powered by artificial intelligence and machine learning that generate Kundali interpretations, predictions, remedial suggestions, and related outputs.
• "User Content" means any data, birth details, personal information, queries, or other material submitted by you to the Platform.
• "Physical Products" means tangible items including gemstones, yantras, rudraksha, puja samagri, malas, idols, and other remedial objects sold through the Platform.
• "Puja Services" means online puja bookings facilitated by the Company through empanelled temples and independent priests.

2. ACCEPTANCE AND ELIGIBILITY

By using the Platform, you represent and warrant that:

• You are at least 18 years of age and legally competent to enter into a binding contract under the Indian Contract Act, 1872, or the equivalent law applicable in your jurisdiction.
• You are registering with your real identity and accurate personal details, and you hold only one active account on the Platform.
• You are not barred by any applicable law, court order, or regulatory direction from using our Services.
• Your use of the Services does not violate any law or regulation applicable in your jurisdiction.

These Terms may be updated at our sole discretion at any time. We will make reasonable efforts to notify registered users of material changes via email or in-app notification. Your continued use of the Platform after any modification constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.

3. DESCRIPTION OF SERVICES

Kundali Shuddhi, operated by Vitta Mantrana Pvt Ltd, is an AI-powered astrology and remedies platform accessible at www.kundalishuddhi.com. The following services are offered:

3.1 AI-Generated Kundali Readings & Reports

We provide automated, AI-generated birth chart (Kundali) analyses, planetary interpretations, dasha predictions, compatibility reports, and related astrological content. All such outputs are produced entirely by artificial intelligence algorithms trained on Vedic and classical astrological systems. Unless a specific service is explicitly described as 'human-reviewed', outputs are not prepared, verified, or reviewed by a human astrologer.

3.2 AI-Suggested Remedies

Based on your Kundali data, our AI systems may recommend remedies including gemstones, mantras, yantras, puja rituals, fasting observances, and other Vedic remedial measures. These suggestions are generated entirely by AI and are provided for spiritual and personal informational purposes only. They must not be construed as medical, psychological, legal, or financial advice.

3.3 Online Puja Services

We facilitate online puja bookings at various temples and through empanelled priests. Vitta Mantrana Pvt Ltd acts solely as an intermediary and facilitator in this regard. The puja is performed by independent priests and temple authorities who are not employees or agents of the Company. We do not guarantee specific religious outcomes, divine blessings, or results from any puja performed through our Platform.

3.4 Physical Product Sales

We sell Physical Products including gemstones, yantras, rudraksha, malas, idols, and other remedial items. Product availability, pricing, and specifications are subject to change without prior notice. Physical Products are shipped to addresses in India and select international destinations.

3.5 Paid Subscriptions & One-Time Purchases

Certain Services are available only through paid subscription plans or one-time purchases. Applicable fees, features included, and renewal terms are displayed on the Platform at the point of purchase.

4. AI SERVICES — IMPORTANT DISCLOSURES

The following disclosures apply to all AI-powered features on the Platform and must be read carefully:

• Explicitly AI-Generated: All readings, predictions, reports, and remedy suggestions on this Platform are produced by artificial intelligence. They are not prepared by, or under the supervision of, a licensed or human astrologer unless explicitly stated for a specific service.
• Entertainment & Informational Purpose Only: All AI-generated outputs are intended solely for entertainment, spiritual reflection, and personal informational purposes. They do not constitute professional advice of any kind.
• No Guarantee of Accuracy: Astrology is a belief-based interpretive system. Kundali Shuddhi does not guarantee the accuracy, reliability, completeness, or suitability of any AI-generated output. Predictions are probabilistic in nature and may not correspond to actual life events.
• Not a Substitute for Professional Advice: AI-generated content on our Platform is not a substitute for professional medical, psychological, financial, legal, or other licensed professional advice. You should independently consult a qualified professional before making any significant life decisions.
• User Responsibility: You assume full and sole responsibility for any decisions made, actions taken, or consequences arising from reliance on AI-generated content. Vitta Mantrana Pvt Ltd bears no liability for any such outcomes.

5. USER ACCOUNT, REGISTRATION & SECURITY

To access Paid Services and personalised features, you must register and create an account. You agree to:

• Provide accurate, current, and complete information during registration and keep it updated at all times.
• Maintain the strict confidentiality of your login credentials. You are solely responsible for all activities conducted under your account.
• Not transfer, sell, or share your account or credentials with any third party.
• Immediately notify us at [email protected] upon discovering any unauthorised access to or use of your account.
• Maintain only one active account on the Platform at any time.

We reserve the right to access your account records to investigate complaints, suspected abuse, technical issues, or legal compliance requirements. We may suspend or terminate your account without notice if we determine that you have provided false information or violated these Terms.

6. FEES, PAYMENTS & BILLING

6.1 Pricing

Prices for all paid Services are displayed on the Platform in Indian Rupees (INR). International users may be charged in their local currency depending on the payment gateway used, subject to applicable exchange rates and transaction fees. Vitta Mantrana Pvt Ltd reserves the right to revise pricing at any time; changes will not affect Services for which payment has already been received.

6.2 Payment Methods

Payments may be made through credit cards, debit cards, net banking, UPI, digital wallets, and other methods available on the Platform. We use third-party payment gateways to process transactions securely. We do not store your full card or banking credentials on our servers.

6.3 Subscriptions & Auto-Renewal

Subscriptions are billed on a recurring basis (monthly or annually) as selected at purchase. Unless cancelled before the next billing date, subscriptions renew automatically and the applicable fee is charged to your saved payment method. By subscribing, you expressly authorise Vitta Mantrana Pvt Ltd to charge the renewal fee on each due date.

6.4 Wallet Credits

Where a wallet or credits system is offered, balances and credits are non-transferable, cannot be encashed, and are not refundable to source payment methods except as required by applicable law. Credits expire as per the terms communicated at the time of purchase. An administrative fee may be levied on unused wallet balances after the validity period.

6.5 Taxes

All prices are exclusive of Goods and Services Tax (GST) and other applicable government levies unless stated otherwise. International users are solely responsible for any customs duties, import taxes, or charges levied by their respective jurisdictions.

7. CANCELLATION & REFUND POLICY

7.1 Digital Services & AI Reports

• Refund requests for digital reports or AI-generated readings must be submitted to [email protected] within 2 (two) hours of purchase, provided the service has not been accessed and the report has not been delivered.
• Once a report has been generated and delivered, or a reading session has been initiated, no refund shall be entertained.
• In case of a verified technical error where payment was deducted but the service was not delivered, you must notify us within 24 hours. Such claims will be investigated and resolved within 7 working days.

7.2 Subscriptions

• You may cancel your subscription at any time through your account settings or by writing to us. Cancellation takes effect at the end of the current billing cycle; no partial-period refunds are issued unless mandated by applicable law.
• Post-cancellation, you retain access to paid features until the end of the paid period.

7.3 Physical Products

• Physical Products may be returned or exchanged only if received in a damaged, defective, or materially incorrect condition. Return requests must be raised within 48 hours of delivery with photographic or video evidence sent to [email protected].
• Products must be returned in their original, unused condition and packaging. Eligible refunds are processed within 7–10 working days after receipt and inspection.
• Customised, personalised, or energised products are non-returnable and non-refundable.
• All refunds are processed after deducting applicable payment gateway charges, two-way shipping costs, and GST.

7.4 Online Puja Services

• Puja bookings cancelled at least 48 hours before the scheduled date are eligible for a full refund.
• Cancellations within 48 hours of the scheduled puja attract a 50% cancellation charge.
• No refund is issued once the puja has been performed.

7.5 Erroneous Double Payments

In the event of a verified duplicate charge for a single transaction, the excess amount will be refunded within 7 working days.

8. USER CONDUCT & PROHIBITED ACTIVITIES

By using the Platform, you agree not to:

• Use the Platform for any unlawful, fraudulent, or unauthorised purpose.
• Submit false, misleading, or inaccurate personal information, including birth data.
• Attempt to access, tamper with, or disrupt our servers, networks, systems, or databases.
• Use automated scripts, bots, crawlers, scrapers, or data mining tools to extract any content from the Platform without our prior written consent.
• Reproduce, redistribute, sell, sublicense, or commercially exploit any Platform content or AI-generated output without our express written permission.
• Upload or transmit any virus, malware, Trojan horse, spyware, or other malicious code.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use the Platform to send spam, junk mail, chain messages, or unsolicited communications to any person.
• Access or use the Platform if you are a competitor of Kundali Shuddhi or Vitta Mantrana Pvt Ltd, or to develop a competing product or service.
• Use any content, data, or AI-generated outputs from the Platform to train, fine-tune, or develop any artificial intelligence, machine learning model, or large language model without our prior written consent.

We reserve the right to investigate violations and take appropriate action, including suspension or permanent termination of your account, without prior notice. Such decisions shall be final and binding.

9. INTELLECTUAL PROPERTY RIGHTS

All content on the Platform — including the name "Kundali Shuddhi", all associated logos, branding, design elements, user interface, text, graphics, AI-generated outputs, astrological interpretations, reports, software code, and databases — is the proprietary property of Vitta Mantrana Pvt Ltd or its licensors and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and applicable intellectual property laws.

You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Platform and Services solely for personal, non-commercial purposes. This licence does not permit you to:

• Copy, reproduce, republish, or publicly display any Platform content.
• Create derivative works based on our content or AI-generated outputs.
• Reverse-engineer, decompile, or disassemble any part of the Platform or its underlying software.
• Use our trademarks, logos, or brand assets without prior written consent from Vitta Mantrana Pvt Ltd.

User Content you submit to the Platform (such as birth details and astrological queries) remains yours. By submitting it, you grant Vitta Mantrana Pvt Ltd a limited, royalty-free, worldwide licence to use, process, and store such content solely for the purpose of providing the requested Services and improving our AI systems in an anonymised and aggregated manner.

10. PRIVACY & DATA PROTECTION

Your privacy is of paramount importance to us. The collection, use, storage, and disclosure of your personal data is governed by our Privacy Policy, available at www.kundalishuddhi.com/privacy-policy, which is incorporated into these Terms by reference.

By using the Platform, you acknowledge and consent to:

• Collection of personal data including name, date of birth, time and place of birth, contact details, and payment information, for the purpose of providing Services.
• Receiving communications from Vitta Mantrana Pvt Ltd via SMS, email, WhatsApp, and in-app notifications regarding your account, transactions, and promotional content. You may withdraw consent for marketing communications at any time by writing to [email protected].
• Storage and processing of your data in India, in compliance with the Digital Personal Data Protection Act, 2023. If you access the Platform from outside India, you consent to the transfer and processing of your data in India.
• Use of cookies and tracking technologies as described in our Privacy Policy and Cookie Policy.

Sensitive personal data, including birth details and religious preference information, will not be shared with third parties for commercial purposes without your explicit consent. Data may be shared with third-party service providers — including puja temples, priests, and logistics partners — only to the extent strictly necessary to deliver the Services.

11. LEGAL DISCLOSURE OF USER DATA

Notwithstanding any other provision of these Terms, Vitta Mantrana Pvt Ltd may disclose user information, including personal data, when required or permitted under applicable law, including:

• Compliance with a court order, subpoena, search warrant, or lawful direction from a government or regulatory authority.
• Enforcement of these Terms or our Privacy Policy.
• Investigation or prevention of fraud, illegal activity, or breach of security.
• Protection of the rights, property, or safety of the Company, its users, or the public.

12. DISCLAIMER OF WARRANTIES

THE PLATFORM AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VITTA MANTRANA PVT LTD EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
• That the Platform will be continuously available, uninterrupted, timely, secure, or error-free.
• That any AI-generated reading, prediction, or remedy suggestion will be accurate, reliable, or suitable to your specific circumstances.
• That results obtained from using the Services will meet your expectations.
• That any content or output on the Platform constitutes professional advice of any nature.

Astrology, Vedic remedies, and related practices are not scientific disciplines. Vitta Mantrana Pvt Ltd makes no representation that any astrological content will influence or predict past, present, or future events.

13. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE INDIAN LAW, VITTA MANTRANA PVT LTD, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform or Services.
• Any decisions made or actions taken by you in reliance on AI-generated content, predictions, or remedy suggestions.
• Loss of data, business, revenue, profits, goodwill, or reputation arising from use of the Platform.
• Service interruptions, technical failures, or errors on the Platform.
• Acts or omissions of third-party service providers including payment gateways, puja performers, temples, priests, or courier and logistics partners.

In any event, Vitta Mantrana Pvt Ltd's maximum aggregate liability to you for any claim arising out of or in connection with these Terms or your use of the Platform shall not exceed the amount paid by you to us in the three (3) months immediately preceding the event giving rise to the claim, or INR 500 (Rupees Five Hundred Only), whichever is higher.

This section shall survive the termination or expiry of these Terms.

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Vitta Mantrana Pvt Ltd and its directors, officers, employees, affiliates, agents, successors, and assigns from and against any and all losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of or access to the Platform or Services.
• Your violation of any provision of these Terms or our Privacy Policy.
• Your violation of any third-party rights, including intellectual property rights.
• Any content or data you submit, post, or transmit through the Platform.
• Your violation of any applicable law or regulation.

15. THIRD-PARTY LINKS, SERVICES & ADVERTISEMENTS

The Platform may contain links to third-party websites, applications, or services. These are provided for convenience only. Vitta Mantrana Pvt Ltd has no control over the content, privacy practices, or terms of any third-party site and assumes no responsibility for them. Your use of third-party services is at your own risk and subject to that third party's terms.

The Platform may display third-party advertisements. Vitta Mantrana Pvt Ltd is not responsible for the content, products, or services advertised by third parties. Any interaction with such advertisements is solely between you and the advertiser.

16. SUSPENSION & TERMINATION

We reserve the right to suspend or permanently terminate your account and access to the Platform, with or without prior notice, for reasons including but not limited to:

• Violation of any provision of these Terms.
• Conduct that is harmful, fraudulent, abusive, or disruptive to other users or the Platform.
• Provision of false, inaccurate, or misleading registration information.
• Non-payment of dues.
• Legal or regulatory requirements.

Upon termination, your licence to use the Platform immediately ceases. Wallet balances or credits remaining at termination due to a violation shall be forfeited without refund. You remain liable for all obligations incurred prior to termination.

17. FORCE MAJEURE

Vitta Mantrana Pvt Ltd shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure is caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, government action, internet or telecommunications outages, power failures, pandemics, or actions of third-party service providers. Performance shall be suspended for the duration of the force majeure event.

18. COPYRIGHT INFRINGEMENT — NOTICE & TAKEDOWN

Vitta Mantrana Pvt Ltd respects the intellectual property rights of all parties. If you believe any content on the Platform infringes your copyright, please submit a written complaint to our Grievance Officer (see Section 20) containing:

• Your full name, address, email address, and contact number.
• A description of the copyrighted work you claim has been infringed.
• The URL or specific location on the Platform where the allegedly infringing material is located.
• A statement that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
• A declaration, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf.
• Your electronic or physical signature.

Upon receipt and verification, we will take appropriate action, which may include removal of the infringing content or termination of the relevant user's account.

19. GOVERNING LAW, DISPUTE RESOLUTION & JURISDICTION

19.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without giving effect to any choice-of-law or conflict-of-law rules.

19.2 Dispute Resolution — Arbitration

Any dispute, controversy, or claim arising out of or in connection with these Terms, including any question regarding their existence, validity, breach, or termination, shall first be attempted to be resolved through good-faith negotiations between the parties within 30 days of one party notifying the other in writing.

If not resolved within 30 days, the dispute shall be referred to and finally resolved by binding arbitration conducted by a sole arbitrator mutually agreed upon by the parties, in accordance with the Arbitration and Conciliation Act, 1996 (as amended from time to time). The seat and venue of arbitration shall be Bhubaneswar, Odisha, India. The language of arbitration proceedings shall be English.

19.3 Jurisdiction

Without prejudice to the arbitration clause above, both parties submit to the exclusive jurisdiction of the courts of Bhubaneswar, Odisha, India for any interim relief, injunctive proceedings, or enforcement of an arbitral award.

In accordance with the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection Act, 2019, the details of our designated Grievance Officer are as follows:

21. ADDITIONAL TERMS FOR INTERNATIONAL USERS

For users residing in the European Union or European Economic Area: You may be entitled to a full refund within 14 days from the commencement of a digital subscription (statutory cooling-off period) under applicable EU consumer protection law. This right lapses once digital content has been accessed with your explicit prior consent and acknowledgement that you thereby waive your cancellation right.

For all users outside India: You access the Platform of your own volition and are solely responsible for compliance with all applicable laws in your jurisdiction. Vitta Mantrana Pvt Ltd makes no representation that the Services are appropriate or legally available in all jurisdictions. We reserve the right to restrict access to users in jurisdictions where our Services may be prohibited by law.

22. GENERAL PROVISIONS

• Entire Agreement: These Terms, together with our Privacy Policy and any additional terms communicated at the point of purchase, constitute the entire agreement between you and Vitta Mantrana Pvt Ltd with respect to the Platform and supersede all prior representations, agreements, or understandings.
• Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
• No Waiver: Our failure to enforce any provision of these Terms at any time shall not constitute a waiver of that provision or our right to enforce it in the future.
• Assignment: You may not assign or transfer any rights or obligations under these Terms without our prior written consent. Vitta Mantrana Pvt Ltd may freely assign its rights and obligations.
• Relationship of Parties: Nothing in these Terms creates a partnership, joint venture, agency, franchise, or employment relationship between you and Vitta Mantrana Pvt Ltd.
• Notices: Notices to you will be sent to your registered email address. Notices to us must be sent to [email protected]. Email notices are deemed delivered 24 hours after sending.
• Language: These Terms are executed in English. In the event of any conflict between an English version and any translated version, the English version shall prevail.
• Headings: Section headings are for reference only and shall not affect the interpretation of these Terms.
